Take Action in Colorado to Protect Access to Hemp

Dear Charlotte’s Web family, 

On April 6, 2023, SB 23-271 was introduced to the Colorado General Assembly by Sen. Roberts and Van Winkle.  This bill is intended to address intoxicating hemp products, like delta-8, and closely tracked the recommendations made by the SB 22-205 Task Force. 

We’re writing today because this week, SB 23-271 has been amended.  Less than 12 days since the bill was introduced and after months of robust debate and discussions by key stakeholders in the SB 22-205 Task Force, the bill sponsors – Sens. Dylan Roberts and Kevin Van Winkle – decided to scrap the SB 22-205 Task Force recommendations and amend the bill with draconian THC and serving limits that will effectively destroy the hemp-derived CBD industry in Colorado. The amended language would limit hemp-derived finished products to 1.75 mg THC mg per serving, and only 5 servings per package.  This would be the most restrictive limitation on hemp products enacted by any state. 

Charlotte’s Web supports the intent behind SB 23-271, to address intoxicating hemp products, but unfortunately as amended the bill would eliminate your access to safe, full–spectrum hemp products in Colorado.  The products that Charlotte’s Web manufactures and sells are full spectrum hemp products with naturally occurring CBD. Full spectrum products contain trace amounts of other plant compounds including THC at less than .3% THC (as permitted under the 2018 Farm Bill).   

SB 23-271 has been referred to the Senate Finance Committee. This committee has the power to protect your access to hemp products by rejecting the amended language and restoring the SB 22-205 recommendations. 

What can you do? If you or your loved ones rely on the health benefits of full spectrum CBD products, we urge you to contact the bill sponsors and Finance Committee members.

Draft Letter for SB 23-271: 

Dear sir or madam, 

As a Colorado consumer and voter, I’m asking you to reject the recent amendments made to SB 23-271 and stick with the recommendations prepared by the SB 22-205 Task Force.  The new limits are arbitrary and would adversely impact Coloradan’s access to hemp-derived products currently available in the market, wreaking havoc on the hemp and CBD industry.  

Please consider: 

  • The amended limits in SB 23-271 are arbitrary and would effectively eliminate access to full spectrum and broad-spectrum hemp products currently available in the market. 
  • This would be the most restrictive limitation on hemp products enacted by any state. 
  • Hemp products do not produce a psychoactive “high.” Full spectrum hemp products are not intoxicating or do not contain chemically transformed delta-8 or THC-O or anything of that sort. By legal definition, hemp is an agricultural commodity that does not contain more than 0.3% of the intoxicant THC. 
  • Thousands of Colorado residents rely on these products for their general wellness, and this bill eliminates their access to full spectrum CBD products via ecommerce or retail outlets. 
  • Hemp and hemp products provide needed opportunities for hemp farmers and small businesses in Colorado that are struggling in today’s difficult agricultural and retail economies. 
  • Legal ambiguity and restrictive regulatory requirements are an excessive burden, stifle the free market, and deprive Colorado citizens’ access to natural beneficial products.  

Please reject the amendments to SB 23-271 and use the recommendations prepared by the SB 22-205 Task Force. I appreciate your consideration.
